Property Tax exemption to Ex-servicemen/widows, disabled jawans/widows in Kerala

The Kerala Government have published revised guidelines for giving property tax exemption to the Ex-Servicemen vide GO(MS) 242/2013/LSGDdated 2.7.2013. The main points are given below:

1.  The exemption is only for Ex-servicemen, their widows, disabled jawans and their widows. They can avail exemption for one house only. The area of the house should be below 2000 sq ft. The exemption is limited for ex-servicemen of army, navy and airforce.

2.  The ex-servicemen/widow/disabled jawan/widow has to submit an application every year before April 10 to claim tax exemption. An affidavit indicating the exemption is availed for only one house is also to be enclosed with the application.


3. They should inform the LSGI's as and when they transfer the house to son/daughter etc. It is the duty of the ex-servicemen.

Note:- It may be noted that there is no exemption for ex-serviceman from paying profession tax.

  1. why below 2000 sq ft.Ex servicemen after putting up of a long service to the nation won't have the liberty to build a house of 2000 sq ft and above and get the exemption of tax. is it justified.

  2. It clearly indicate the inefficiency of our system of administration. Every Ex-servicemen is provided with a personal number. Further every Indian is provided with an ADAAR No: (UID Number) If the panchayath wants to verify the duplication of availing house-tax exemption it can be easily verified through their regimental No or UID. I strongly believe that an ex-serviceman is not able to build more than one house in his life time. It is torture and a proper streamline procedure need to be formulated so that old aged persons need not to stand in long queue every year to get an exemption from the local body considering their service to the nation, during their service period.

Filing an application before 10th of every year to claim tax exemption for ex-servicemen is a bit harassing procedure.It can be changed to a one time affair with a self declaration by the individual that any property transfer will be promptly reported to the local body with liability for penalty for any infringement of the condition.Or else, make the duration at least once in 5 years.If that also is not possible for any technical reason,do away with the date clause and make it liberal to alleviate the difficulties to the ex-service senior citizens.Can the Govt consider this suggestion positively?....

  5. Submission of application for building tax exemption every year, before April 10th is a procedure which can be made to every 5 years or so. In the case of exservicemen of senior citizen age group, it is a necessity. I request the authorities to consider, extension to 5 years.

  6. In Kerala only ex-servicemen community is facing this much huge colour prejudice and also this is making by the civics gentlemen, who are working in local bodies. They are tracing out the loop hole of the rules and taking its advantage to making rules on that. Such one creation is the "every year Application and affidavit" submission. All most all the ex-servicemen are sexagenarian, who have given the best years of their life for the nation. At the last stage they returned to their home state for peaceful stay are facing this much man made creations.. So I do have submission to the authorities to abolish the every year submission of "Application and Affidavit" and allow the ex-servicemen to live their last lap of life peacefully.

  7. I had been take up this case to the Director of Sainik Welfare, Trivandrum and i received a letter from them informing that the case has been taken up with the state Government and the decision is pending as usual.

      Have a doubt, is the exemption applicable for luxury tax. i have house with 2700 sq feet and forced to pay 4000 every year in advance. In addition to the lumpsum paid as one time payment

  8. This is the time to submit documents for tax exemption (01 to 10 Apr), hence the genuine request forwarded by Mr. Venugopal Palakkattu requires urgent attention. Please publish any updation came up from the side of State Govt or Sainik Welfare Department. Usman

  9. Ex-servicemen are exempted from house tax for house in their name not exceeding 2000 sqft. It means that ex-servicemen whose house is beyond 2000 sqft is not entitled to the benefit. Their service to the nation is totally ignored for reason of building a house exceeding 2000 sqft. It should not be like that. Either govt should remove this limit or permit ex-servicemen to avail exemption upto 2000 sqft and pay for the remaining area. Clear order on this issue needs to be issued at Panchayat level.

      That's an excellent thought. It would be unfair, illegal to charge the entire tax from an ex serviceman who has a dwelling house more than 2000 sq ft. Only the additional sq ft in excess of 2000 sq ft. should be charged.

Sir I am sajitha.widow of late Cpl Anil Kumar.my husband died before 15 yrs..my house is more than 2000sq ft..now a day ..some people force me to pay building tax from Panchayat .it's 12000(2013-2018)..after my husband death my father build this home for me...and now he is no more...I have 2 childrens one son and daughter...they are studying..I don't have much money to pay tax...only 9000 RS pension for me...what will I do sir.... people from Panchayat is too harrassing me..what will I do sir...only little sq more than 2000...what will I do sir...plz rply sir

  10. No service without money is the situation in Kerala. It is very paining for an ex-serviceman who served the nation without taking any bribe. Authority needs to address this issue seriously.

  11. Filing an application by 10 Apr every year by ex servicemen is really harassing. Further, inquiry at KMC reveals that the applications will be accepted by them only after 01 Apr. What about those ex service men who retire between 11 Apr and 31 Mar. They have to forgo almost one year's exemption. I request the authorities to consider acceptance of application any time after retirement and grant excemption of property tax from that date. And the requirement of filing of affidavit every year may be looked into.

No justification that it took more than one and a half year and may be more to get a reply from government in this regard?. Shame on the administration. Now there is no other way than to approach to the central government or the court.

    1. Dear sir, could you please give me a suggestion in my case. I am an ex service man and since 2013 I did not submit paper work to Grama Panchayat. Last month (Feb) I got a letter from panchayathu office which that I have to pay tax. I went to panchayathu office and tell them in 2010 I submit my PPO and other document here. Then only I came to know since 2013 rule get changed and have to submit paper work every year. Now is there any posibile way to get exempted from the previous years tax. 9048721084

  14. For Apartments 2000sft is quite vague. The corporation revenue inspector has taken buit up area of the apartment which is 1670sft in my case and added another 370 sft common area which is undivided . Not clear for apartments as the govt circular is vague and says floor area not more than 2000sft

  16. Not only the ex-servicemen, but everyone is serving the nation. The only difference is that the defence personnel are serving our motherland with great sacrifices. They are sacrificing their teenage, young blood, family life and facing dangerous situations throughout their service life. If they come back came back. When they start living a civil life with grown up children and other family responsibilities, their day-to-day expenditure goes beyond their reach. Anybody can make a survey on how many ex-servicemen built their houses with their service earnings only. Some must have sold out their ancestral property or wife's ornaments or taken a loan.
    So the Central Government and State Governments may take merciful decision to exempt profession tax and property tax for the ex-servicemen without any ceiling.

  19. Yes as per the municipality/Panchayat authorities car porch is also included while calculating the plinth area, this is according to my experience only.

    The case of exemption of building tax to ex servicemen is still under consideration by government agencies and a regular followup is required by sainik welfare department concerned.

  21. No way you have to pay the dues as per the existing order. It is really very irritating issue that every year ex servicemen should report to the authorities concerned with their discharge certificate to prove that they are ex servicemen!!!!!!! Shame on who make this order

  22. In case the ESM failed to submit application before 12 April, and submit it later, will the authorities accept and avail exemption or not.

  24. 1. The EXSM will submit an affidavit to the concerned L.S.G. Body recording the house no in the name of his wife certifying that the EXSM has no other house in his name elsewhere and that similar concession is not being availed for any other house in the name of his wife.
    2. Whenever the exemption from property tax for a house in the name an EXSM/widow/his wife is granted, such fact should be recorded in discharge book or service record.
    3. Whenever the EXSM/ widow/ wife transfers the ownership of such a house, the information should be furnished to concerned L.S.G authorities.
    4. On the demise of such EXSM / widow/ wife the information should be furnished immediately to concerned authorities by next of kin.

  25. Is the limit of 2000 sq ft is for the building portion in ground floor. if some is having house of exceeding 2000 sq ft for both upstair and ground floor, he is not entitled for exemtption?

  26. As per the present rule, ex-servicemen and widow are entitled tax exemption for a house up to 2000 Sq ft. You stick on this entitlement, if your house is more than 2000 Sq ft. Apply for the exemption for 2000 Sq ft and the remaining part (Sq Ft) to be taxed as per the existing rule.

  27. During 2010 SM Vijayanand the then Chief Secretary to the Kerala Govt has wrote to Col Thappa Director ESM that all ex-servicemen are exempted from paying property tax for one house irrespective of plinth area. I do not know who has changed to restrict to 2000 sq ft.

    Please explain how to calculate PLINTH AREA.


    Please explain the Plinth Area also.

    Please go through this and take all moves with local bodies in writing and take proper receipt of submission of the application.

    If the house is above 2000, then submit application for tax exemption for the 2000 and remaining area to be taxed.

    Submit application be fore 31 Mar 2018.
